Pearl Street Collective (“Pearl Street”, the “Company,” “we,” “our,” or “us”) is committed to protecting the privacy of your information. This Privacy Policy (the “Privacy Policy”) describes how Pearl Street collects, uses, and shares information from individuals who use the Company’s websites (pearlstreetcollective.com) (the “Site”), or who participate in our search and consulting services (the “Services”). We strive to help you understand how we use your information to improve our products, services, marketing, and interactions with you, as part of our commitment to maintaining your trust.

1. Information Collected

We may collect a variety of information from or about you from various sources, as described below.

  • Information You Submit to Us. When communicating with Pearl Street, you may voluntarily submit to us your personal contact information, such as your name, job title, company name, physical address, mailing address, email address, work/home/cell phone numbers, social media account information, as well as additional personal information such as your gender, race, ethnicity, and citizenship status, and other information that could reasonably be used to identify you personally. If you are a prospective Candidate or a Candidate, you may also submit professional or employment-related information or such as your employment objectives, past and current employment and professional experience, educational background, language skills, compensation, ability to work in the United States, reference information, background check related information and other data information that you provide to us through correspondence, telephone call, a resume or CV. If you are a Client, you may provide us with a unique password used to login to your private database such as customer relationship management software or talent management platform, and payment related information such as a credit card or bank account number. If you are a vendor or independent contractor, you may provide us with contact information for you or your employees and your payment information.

  • Information That Is Automatically Collected. As you navigate the Site, Pearl Street may also collect information through commonly-used information-gathering tools, such as cookies and Web beacons. Navigational information includes standard information from your Web browser (such as browser type, browser language, settings and behavior, operating system, hardware, mobile networking information), your Internet Protocol (“IP”) address, IDFA, Android/Google Advertising ID, IMEI, or another unique identifier, and the actions you take on the Site (such as the Web pages viewed and links clicked, referring and exit web pages and URLs), your device location or other location information including zip code, state or country from which you accessed the Site. For example, Pearl Street uses IP addresses to monitor the regions from which visitors navigate to the Site. In addition, we may use third party services, such as Google Analytics, that collect, monitor and analyze this type of information in order to increase the functionality of the Site. These third parties may use cookies to help us analyze how you use the Site, and they have their own Privacy Policies addressing how they use such information. The Google Analytics service is provided by Google Inc. You can opt-out from Google Analytics service using your information by installing the Google Analytics Opt-out Browser tool: https://tools.google.com/dlpage/gaoptout. Certain other Device data, including the time of day you visit our Site or other information used to provide analytics or other usage information, information about your engagement with our emails; and statistical information about how both unregistered and registered users, collectively, use the Site and Services may also be automatically collected. This aggregate information is derived from Personal Information but cannot be tied back to you or your web browser.

2. Use of Information Collected

We use the information we collect:

  • To respond to your inquiries and answer your questions, to provide you with requested information, and to perform our Services.

  • To provide, operate, maintain, improve, and enhance our Site and computer systems;

  • To understand and analyze how you use our Site and develop new features, and functionality;

  • To communicate with you, provide you with updates and other information relating to our Services, provide the information that you request, respond to comments and questions, and otherwise provide support to Clients and Candidates;

  • To receive applications and nominations on behalf of our Clients; and to evaluate your application for employment or to administer employment benefits;

  • To maintain appropriate records for internal administrative purposes;

  • To comply with applicable laws and regulations or requested by any judicial process or government agency; and

  • For other purposes for which we provide notice at the time the information is collected.

3. Cookies

We use cookies and other tracking technologies to personalize your experience, analyze user trends, and improve our Services. These tracking technologies allow us to collect information such as your device type, browser type, interactions with our Site, geographic location, your web request, the date and time of your web request, your IP address, the domain name of your Internet service provider and other data. If you can be identified from this information, for example by combination with other pieces of information, then we will treat this information as Personal Information. Many browsers default to accepting cookies. You may be able to change this setting in your browser and you can also clear your cookies. Check your browser’s help function to learn more about your cookie setting options. Other data technologies may be used that collect comparable information for security and fraud detection purposes.

4. Your Choices

Cookies. On most web browsers, you will find a “help” section on the toolbar. Please refer to this section for information on how to receive a notification when you are receiving a new cookie and how to turn cookies off. Note, however, that if you reject our request to use cookies or turn cookies off, you may be unable to access certain parts of the Site and you may not be able to benefit from the full functionality of the Site.

Do Not Track. Your browser may offer you a “Do Not Track” (“DNT”) option, which allows you to signal to operators of websites and web applications and services (including behavioral advertising services) that you do not wish such operators to track certain of your online activities over time and across different websites and platforms. There is no universally agreed-upon standard for what an organization should do when it detects a DNT signal. Communication Preferences. With your consent, Pearl Street communicates with you via a variety of media. To help us make emails more useful and interesting, we use pixels that enable us to see if you open emails from us, if your computer supports such capabilities. You can opt out of receiving emails from us at any time. 5. Sharing of Information Collected

  • To Provide Services. We share information as necessary for business and commercial purposes in order to provide Services. For example, information about a Candidate or Reference may be shared with our Clients. We may also share information about Clients with Candidates, prospective Candidates, and References.

  • Vendors and Service Providers. We may share any information we receive with vendors and service providers retained in connection with the operation of the Site, the provision of our Services, to support our business operations, or to communicate with you. For example, Pearl Stret may share your information with the Company’s service providers so that these service providers can communicate with you on our behalf, using the contact information you provided to the Company.

  • Analytics and Advertising Partners. We use analytics services to collect and process certain analytics data as described earlier in Section 1.

  • As Required by Law and Similar Disclosures. Pearl Street reserves the right to access, use, preserve, or disclose your information if we believe doing so is necessary or appropriate to: comply with law enforcement requests and legal process, such as a court order or subpoena; respond to your requests; or protect your, our, or others’ rights, property, or safety.

  • Merger, Sale, or Other Asset Transfers. We may transfer your information to service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company, or we sell, liquidate, or transfer all or a portion of our assets.

  • Consent. We may also disclose your information with your permission.

6. Links to Other Sites

Our Site may contain links to other websites, products, or services that we do not own or operate. We are not responsible for the privacy practices of these third parties. Please be aware that this Privacy Policy does not apply to your activities on these third-party services or any information you disclose to these third parties. We encourage you to read their privacy policies before providing any information to them.

7. Children’s Privacy

We do not knowingly collect, maintain, or use personal information from children under 18 years of age, and no part of our Services are directed to children. If you learn that a child has provided us with personal information in violation of this Privacy Policy, then you may alert us at hello@pearlstreetcollective.com.

8. International Transfer of Information Collected

Pearl Street is a United States company and the Site is hosted in the United States. If you choose to communicate with us or visit the Site from the European Union, the United Kingdom, Switzerland, or other regions of the world with laws governing data collection and use that may differ from United States law, then please note that you are transferring your personal information outside of those regions to the United States for storage and processing. We may also transfer your information from the United States to other countries or regions in connection with the storage and processing of data, fulfilling your requests, and providing our Services. By providing any information, including personal information, directly to Pearl Street, or to the Company on or through the Site, you consent to such transfer, storage, and processing.

9. EEA and UK Residents and General Data Protection Regulation

Pearl Street acknowledges that if you are a resident of or located within the European Economic Area (“EEA”) or the United Kingdom (“UK”), you have certain data protection rights under the General Data Protection Regulation (“GDPR”). We take steps to ensure that appropriate safeguards are in place to guarantee the continued protection of your personal data and that the Personal Information we process is limited to the Personal Information reasonably required in connection with the purposes set out in this Privacy Notice. Company is the data controller of Personal Information. As such, we determine the purposes and means of processing your Personal Information, such as when we collect, use, and share Personal Information, and must have a lawful basis for processing for doing so. Should you wish to raise a concern about our use of your data (and without prejudice to any other rights you may have), you have the right to do so with your local supervisory authority; however, we hope that we can assist with any queries or concerns you may have about our use of your Personal Information first by contacting us at hello@pearlstreetcollective.com.

10. California, Colorado, Connecticut, Nevada, Utah, Virginia Residents

Pearl Street acknowledges that residents of California, Colorado, Connecticut, Nevada, Utah and Virginia have certain rights associated with the personal information received and retained by the Company through data privacy laws. We assure you that Pearl Street does not sell information about you, and where permitted by law, you may make a request to confirm, access, correct, delete, obtain a copy, or opt-out of the processing of your personal data. 11. Security

Pearl Street makes reasonable efforts to protect your information by using appropriate administrative, technical, and physical security measures designed to protect unauthorized disclosure, access to, or loss of the information we maintain. However, as no electronic transmission or storage of information can be entirely secure, we can make no guarantees that our safeguards will always work.

12. Changes to this Privacy Policy

From time to time, we may change this Privacy Policy. We will post a prominent notice of any material changes to the Privacy Policy on the Site, and indicate at the top of the notice when it was most recently updated. Your use of the Site following any such change constitutes your agreement to follow and be bound by the Privacy Policy, as amended.
